I beg to differ with you.

I have VDS-PRO version 2.0.9 which I dowloaded directly from your server
(*). It has NO copyright notice or license agreement of any kind, nor
does it even give the slightest indication where it came from.

I also have OBD2SCAN version 1.2.60, also downloaded directly from your
server (**). This program does indeed have a Baum Tools "logo" on the
opening screen, but that does not constitute a copyright notice!

Now I personally DO understand the copyright laws -- the lack of a
copyright notice does NOT put the software in the public domain, but it
does allow an "innocent infringement" defense...

(*) During the summer of '99, you posted an message to the newsgroup
R.A.M.V.W. inviting existing VWTool users to upgrade to VDS-PRO version
2.0.9. At the time, your website contained a link to the download. As
a legitmate VWTool user -- I had version 2.0.6 which I obtained directly
from CarComp -- I took advantage of your offer.

(**) At the same time I also upgraded OBDTool from 1.2.57 (which I also
purchased directly from CarComp) to 1.2.60 from your server. Although
you did not expressly invite OBDTool users to update, you had a link to
OBD2SCAN 1.2.60 in the Software Updates section of your website...

FWIW, I have orginal CarComp floppies, manuals, and receipt/invoice for
both VWTool and OBDTool.
